TERMS AND CONDITIONS FOR PROS WORKS SUBSCRIPTION SERVICE

These Terms and Conditions ("Terms") govern your use of the annual subscription-based maintenance service (the "Service") provided by Pros Works LLC ("Company," "we," "us," or "our"). By purchasing and using our subscription service, you ("Customer," "you," or "your") agree to abide by these Terms.



1. SUBSCRIPTION SERVICE

1.1 Service Scope
The Service provides scheduled maintenance, diagnostic services, and priority support for household appliances, as outlined in the selected
annual subscription plan. The specific details of each plan, including services covered and limitations, will be provided at the time of subscription purchase.

1.2 Service Availability
Services under the subscription are available only within the designated service areas. Availability may be affected by weather conditions, unforeseen circumstances, or other factors beyond our control.

1.3 Non-Transferable
Your subscription is non-transferable and is tied to the address specified at the time of purchase.



2. SUBSCRIPTION TERM, RENEWALS, AND CANCELLATION

2.1 Subscription Term
All subscriptions are
yearly contracts and are valid for a 12-month period from the date of purchase.

2.2 Auto-Renewal
Subscriptions automatically renew
annually at the end of each term unless canceled by you before the renewal date. By enrolling, you authorize us to charge your payment method on file for the renewal amount.

2.3 Cancellation Policy

  • You may cancel your subscription at any time, but cancellations will only prevent future renewals.
  • You will continue to receive the Service for the remainder of the 12-month paid subscription term.
  • No refunds, full or partial, will be issued for any cancellation.



3. PAYMENT TERMS

3.1 Payment Authorization
By subscribing, you agree to provide accurate and up-to-date payment information. Failure to process payment may result in service suspension or termination.

3.2 Non-Refundable Policy
All subscription payments are final and non-refundable.
No refunds or credits will be issued for partial use, early cancellation, or unused service periods.

3.3 Failed Payments
If payment fails, we will make reasonable attempts to process it again. If payment remains unsuccessful, your subscription may be suspended or canceled at our discretion.



4. SERVICE LIMITATIONS AND LIABILITY DISCLAIMER

The Service does not cover:

  • Repair or replacement of parts unless explicitly stated in the subscription plan.
  • Damage caused by misuse, negligence, unauthorized repairs, or external factors (e.g., natural disasters).
  • Appliances deemed unrepairable or beyond their useful life.

4.2 Liability Limitation

  • We are not responsible for incidental, consequential, or indirect damages arising from the use or inability to use our Service.
  • Maximum liability, if any, shall not exceed the amount paid for the current subscription term.

4.3 Force Majeure
We are not liable for delays or failure to perform due to events beyond our control, including but not limited to natural disasters, government actions, or labor strikes.



5. MODIFICATIONS TO TERMS

5.1 Changes to Service
We reserve the right to modify or discontinue any aspect of the Service at any time. If material changes affect your subscription, we will provide notice.

5.2 Amendments to Terms
We may update these Terms periodically. Continued use of the Service after modifications constitutes acceptance of the revised Terms.



6. GOVERNING LAW AND DISPUTE RESOLUTION

6.1 Governing Law
